TECHNICAL NOTES
ALL FLOORING
1. PIPES & CABLES:
We are unable to accept responsibility for damage to non-visible pipes and cables (under floors and skirtings etc.), unless previously advised of whereabouts. We are unable to accept responsibility for damage to pipes if damaged by vibration, or if they have previously been pierced by a nail.
(For example: when a floorboard which has previously been nailed down and the nail sticks into the pipe, but doesn’t leak until loosened by vibrations from our work), or when pipework is already loose. Solid pipework should survive even a direct hit.
2. SKIRTINGS:
Skirtings (especially if freshly painted) may require some touching up after your carpet or floor has been fitted.
3. STAIRS:
When carpet or floors are fitted on stairs, the paintwork around the stairs may require some touching up after installation (especially if freshly painted). If stairs are unstable in any way prior to installation, we take no responsibility for any damage caused by installation.
4. CEILINGS:
Especially in old or recently refurbished properties, our work may affect plaster in adjacent areas. We can accept no responsibility for plaster affected in this way to you or your neighbours’ properties. Sound plaster should usually be unaffected.
5. COMPUTERS/ AUDIO/ TV’S etc:
Please unwire these items prior to fitting if they need to be moved. Wiring & re-wiring can be extremely complicated. If the equipment is not unwired when we arrive, we cannot guarantee it will work if you ask us to plug & unplug cables. We will not be liable for replacement of goods if they were not checked by the customer prior to installation.
6. CLEANING:
Please follow all manufacturers cleaning instructions. These will normally be with the products when delivered, if they are not, please request and we will be happy to email them to you. We can accept no liability if these are not followed, or if they did not arrive or were lost and not requested from our office.
7. SUBFLOORS:
Our quotation will be based on what is visible. If for example we uplift the old flooring and find that the subfloor requires additional work, we will quote for that work as an extra. Any extra unforeseen work will be chargeable.
8. CHANGES AFTER SURVEY.
Please advise us of any changes to site that may affect quantities of materials, types of accessories or floor preparation after we have surveyed. Any additional materials or labour required might be chargeable.
9. PARKING:
Please advise us of any parking restrictions and whether a permit will be required.
10. DOOR TRIMS:
If door trimming is required, we can arrange this via a specialist company at a cost of £50 for the first door and £30 thereafter. This may be payable directly to the contractor.
11. CANCELLATIONS:
It may not be possible to cancel orders once the carpet or flooring has been ordered from the supplier. If it is possible a restocking charge will incur, which you are liable for.
12. MOVING FURNITURE:
If we have quoted to move furniture, this assumes that books, china, glass, and any other small breakable items must be moved in advance by the customer. Please also empty drawers of clothes, and strip linen from beds. If this is not done, we reserve the right to charge additionally.
WARDROBES:
These are always moved at your risk, unless dismantled prior to our arrival.
13. INSTALLATION/SUPPLIER’S INSTRUCTIONS/BRITISH STANDARD:
We tailor our installation to your project. Sometimes this will be at odds with Supplier’s Instructions or British Standards, which by necessity cover any possible environment. If your project requires installation to British Standard or Supplier’s Instructions, you must advise us in writing before ordering, and we will prepare our quotation accordingly.
14. CARPET SAMPLES:
Samples are roughly representative only. Like all dyed materials, colour will vary in shade between different batches. For example, between sample and carpet supplied. We cannot be held accountable if the carpet colour you receive is not identical to the sample carpet colour. Features such as track lines from manufacture may not be obvious on a small sample, and other features visible over large areas may not be visible from a small sample.
15. WOOD/CORK SAMPLES:
Samples are roughly representative only. A sample cannot show all the features of a wood floor. Shakes and Knots and other grading features, including colour variation may not appear on a sample. Wood also varies from batch to batch, as does stain. There will be some variations from the sample. Smoked floors use ammonia smoke to react with the natural Tannins in the wood. Smoked floors will vary from batch to batch.
16. UNDERFLOOR HEATING:
Please inform us if you are installing carpets or flooring over under-floor heating. Systems must be switched off 48 hours prior to installation of Wood, Amtico or Marmoleum or any other hard floor. When the system is switched back on, start low and increase the temperature slowly. Under-floor heating can affect the relative humidity of a floor causing cracks or gaps. If this begins to happen please use a humidifier to restore relative humidity.

17. SUPPLY ONLY ORDERS:
Any flooring supplied only for you and fitted by you will be your own responsibility. If you are installing a floor or carpet purchased from us but installed by yourself you must inspect and check you are happy with the floor/ carpet prior to fitting. Any sizes given to us will be your responsibility.
We will not accept any complaint after the carpet or floor has been fitted. We only supply carpets and floors on this understanding.
18. LEVELLING/ SMOOTHING FLOORS:
When we refer to levelling of floors it would be more accurate to describe it as smoothing of floors. Particularly in older properties the floor will rarely be completely flat as the building may have settled, or work has been done on the floor over the years. Therefore, to prepare the floor to accept new flooring or carpet we will smooth over the subfloor using plywood or screed. This means that some of the unevenness in the floor may still be visible particularly with plain flooring in strong light. It also means that if you select a floating floor there may be some minor movement.
CARPETS
19. STAIRS:
When Stair Runners are fitted it may cause the paint between the flat and the riser to crack which may entail some minor touching up afterwards.
20. SHADE VARIATION:
Like all dyed materials, carpets can vary slightly in shade between different batches (e.g. between sample and carpet supplied). Velvet and cut pile carpet may develop light and dark patches. This shading or pooling is not a defect and will not affect the wear of your carpet.
21. PILE REVERSAL:
Pile reversal or pooling is a phenomenon that can affect any carpet, but is usually more evident in velvet or cut pile carpet. It manifests as dark shading, and pools on the carpet as if water has been split on the carpet. It is down to local conditions and cannot be reasonably predicted. If a replacement carpet is supplied, it will usually pool again. This rare fault cannot be reasonably predicted, and therefore is not a fault.
22. RE-STRETCH:
If carpet requires re-stretching, this will be done free of charge, up to 2 years from the date of fitting. After this, re-stretches are chargeable.
WOOD FLOORS/CORK FLOATING FLOORS
23. WOOD FLOORS:
Wood is a natural material and can move in response to changes in heat and humidity. During this process small gaps may appear between the boards. This is a natural feature of timber flooring.
24. WOOD SAMPLES:
Wood samples are representations of product actual floor may vary in colour or grade.
25. UNDERCUTTING SKIRTINGS:
Undercutting skirtings will cause some damage to skirtings. A decorator will need to repair after installation. We must be advised if there are electrical/alarm/telephone wires behind the skirtings. If we are not advised and we hit one of these wires, we will attempt to repair, but cannot be liable should specialists need to repair.
26. FLOATING FLOORS:
Unless the subfloor is perfect (unlikely in most properties) there may be some movement in any floating floor.
27. INSTALLATION/SUPPLIER’S INSTRUCTIONS/BRITISH STANDARD:
We tailor our installation to your project. Sometimes this will be at odds with Supplier’s Instructions or British Standards, which by necessity cover any possible environment. If your project requires installation to British Standard or Supplier’s Instructions, you must advise us in writing before ordering, and we will prepare our quotation accordingly.MARMOLEUM/AMTICO/RUBBER/HARD FLOORS
19. MARMOLEUM:
Sometimes Marmoleum will develop a yellowish tinge (stoving) during storage; this is a natural reaction, which will disappear over a few days when exposed to light.
21. SMOOTHING OF FLOORS.
When fitting smooth floors (Amtico/Rubber/Marmoleum) the Floor will be smoothed to take out as much unevenness as possible. It will not always be possible to make the floor totally even. Contours of the sub-floor will be visible this is especially the case with plain flooring.
TERMS & CONDITIONS OF SALE
GENERAL
1. FORMATION OF CONTRACT:
The Contract between Pan Global Flooring Ltd t/as Brocklehurst Commercial and Customer comprises the
Confirmation of Order signed by Pan Global Flooring Ltd t/as Brocklehurst Commercial (the ‘Order’) and these Terms and Conditions. Any other terms proposed by the Customer are excluded
2. PAYMENT TERMS:
A 50% deposit is required at point of order. The balance is to be paid in full prior to fitting, unless alternative arrangements
have been agreed in advance. You will receive an invoice by email, a few days prior to installation. You may settle your account using cash or
credit/debit cards. Card payments can be taken over the phone or in store. BACS payments are to be paid to the bank account shown on the foot
of your invoice email, and should include your name and first line of address.
Should an account not be settled a reminder will be sent. Should it be necessary for further reminders to be sent, administration charges may
occur. After due notice, unpaid accounts will be referred to our debt collection agency, and further charges will be applied.
3. DELIVERY & INSTALLATION:
All delivery and installation dates given by the Pan Global Flooring Ltd t/as Brocklehurst Commercial are given in good
faith but dates are not guaranteed and we will not be liable to the customer for any delay in delivery. Pan Global Flooring Ltd t/as Brocklehurst
Commercial will notify the customer when the products are ready for delivery.
4. OWNERSHIP & RISK:
The risk of loss or damage to the products passes to the customer upon delivery or installation. Ownership of the products
will remain with Pan Global Flooring Ltd t/as Brocklehurst Commercial until payment in full of all amounts due, have been received..
5. LIABILITY:
Pan Global Flooring Ltd t/as Brocklehurst Commercial does not limit or exclude any liability for fraud or for death or personal injury
resulting from Pan Global Flooring Ltd t/as Brocklehurst Commercial’s negligence. Otherwise, Pan Global Flooring Ltd t/as Brocklehurst Commercial
will not be liable for replacement of good if they were not checked by the customer prior to installation. Under no circumstances whatever shall Pan
Global Flooring Ltd t/as Brocklehurst Commercial be liable for losses special to the particular circumstances of the Customer or in connection to:
indirect loss; loss of profits; damage to goodwill reputation; damage to property; wasted expenditure; consequential losses; economic loss; special
damages and indirect losses; business interruption, loss of business, contracts, opportunity and/or production.
6. WARRANTY & LIABILITY:
Pan Global Flooring Ltd t/as Brocklehurst Commercial will exercise reasonable skill and care in the manufacture or
preparation of Products (where applicable). Any defects should be notified within one month of delivery or installation. When Pan Global Flooring Ltd
t/as Brocklehurst Commercial accepts that the defect is due to faulty workmanship or materials Pan Global Flooring Ltd t/as Brocklehurst Commercial
will have the option either to repair or replace the defective Product. The warranty given above will not apply to defects which are due to: fair wear and tear, accidental damage or failure by the Customer to adhere to Pan Global Flooring Ltd t/as Brocklehurst Commercial’s recommendations. Or to inspect products prior to installation.
7. FORCE MAJEURE:
Pan Global Flooring Ltd t/as Brocklehurst Commercial will not have any liability to the Customer if prevented from performing the Contract on account of force majeure which includes, but is not limited to severe weather conditions, war, terrorism, strikes or difficulty in obtaining materials and labour. In any of these circumstances, Pan Global Flooring Ltd t/as Brocklehurst Commercial reserves the right to cancel or delay the Order.
8. LAW & DISPUTES:
The contract between customer and seller is governed by English Law. Any dispute that cannot be resolved will be referred to mediation at the request of either party. CEDR (the Centre for Effective Dispute Resolution) will arrange mediations. Should a dispute require a technical opinion, the customer and Pan Global Flooring Ltd t/as Brocklehurst Commercial will jointly instruct and pay for an independent inspection.
In the case of carpet by BTTG and for all other floors, the Contract Flooring Association. The results of this inspection will be considered binding on both parties.
9. RETENTION OF TITLE.
All goods remain property of Pan Global Flooring Ltd t/as Brocklehurst Commercial Flooring until paid for in full
10. SPECIFICATION:
Save as provided in these conditions, the quantity, quality and description of the Goods shall be as expressed in the Quotation or (if different) in the Order and/or in any applicable specifications supplied or advised by Pan Global Flooring Ltd t/as Brocklehurst Commercial to the Customer. The Customer is responsible for checking the Quotation and satisfying itself that any specification including in the case of Made to Measure Goods given is accurate and adequate. Pan Global Flooring Ltd t/as Brocklehurst Commercial reserves the right at any time to alter the dimensions or composition of the Goods to conform to applicable standards or laws or otherwise within reasonable limits having regard to the nature of the Goods.
The Goods shall be of satisfactory quality and reasonably fit for the purpose of merchandise of the nature of the Goods. The Customer acknowledges that: unlike machine-woven Goods; hand-woven or hand-knotted Goods ordered from Pan Global Flooring Ltd t/as Brocklehurst Commercial will not have a uniform finish and agrees that Pan Global Flooring Ltd t/as Brocklehurst Commercial shall not be liable for any discrepancies in such hand-woven or hand-knotted Goods including but not limited to slight variations in colour and weave unless caused by Pan Global Flooring Ltd t/as Brocklehurst Commercial’s negligence; velvet hand-woven carpets may show Pile Reversal and that such Pile Reversal is not a manufacturing defect.
